1. General The General Terms and Conditions (T&Cs)

Serve as an indispensable foundation for a balanced and fair relationship with our customers. By placing an order, the customer expressly agrees to the conditions set out in the General Terms and Conditions. Our primary goal is to provide our customers with services and products that meet their individual needs and achieve their fullest satisfaction. In order to ensure the readability of our General Terms and Conditions, we use the masculine form. However, this in no way excludes that we also address our female customers.

2. Scope The present General Terms and Conditions (T&Cs)

Regulate the relationship between Edgewind GmbH, Sandgrubenstrasse 44, 4058 Basel (hereinafter referred to as "ArtOnVino" for the web presence), and you as an ArtOnVino customer (hereinafter referred to as "customer" or "you"). Deviating agreements require written form for their validity. Our entire offer at http://artonvino.com is aimed at customers within Switzerland and the Principality of Liechtenstein. There will be no deliveries abroad.

3. Conclusion of contract 

 

With the exception of section 8.1, the offer to conclude a contract comes from you as a customer, by clicking the "Complete Order" button after completely filling out the order page. You are bound by the order for one week. The contract comes into effect when we accept the order within this period in accordance with the following provisions. After sending the order, you will receive an automated email in which we confirm the receipt of the order (order confirmation). The order confirmation merely serves to inform that we have received the order. A contract is only validly concluded when we declare acceptance of the contract. We declare the acceptance of the contract by sending an invoice to the customer, confirming the order (order confirmation), confirming by email that the goods are leaving our warehouse (dispatch confirmation), or at the latest by delivering the goods. The contract is only concluded for those articles which are expressly listed in our invoice, order confirmation, or shipping confirmation. This also conclusively determines the scope of services. The customer has the option to print out the order and the entered data during the ordering process. There is also the possibility to open a customer account. In the customer account, the order data can be viewed after entering the personal access data. ArtOnVino reserves the right to block customer accounts without giving reasons at its discretion. 

 

4. No sale to minors 

 

ArtOnVino does not sell alcohol to minors under 18 years of age. With his order at http://artonvino.com, the customer confirms the correctness of his information and thus his authorization to purchase. 

 

5. Purchase of vouchers 

 

Vouchers must be paid for directly when purchased via the online shop. Purchase on account is not possible. After completing the purchase, the customer will receive the vouchers as a PDF file to print out themselves by email. The minimum amount for a voucher is CHF 20, the maximum voucher amount is CHF 1500. A voucher entitles the holder to receive goods/services in our online shop. Vouchers cannot be returned or paid out in cash. In the online shop, a voucher can be used during the payment process by entering the voucher number. The voucher amount is credited to the purchase price. If the full amount of the voucher is not reached when paying with a voucher, the corresponding remaining balance on the voucher expires. If a holder purchases for a higher amount than the voucher amount, the difference has to be paid during the payment process. 

 

6. Special conditions for end customers 

 

6.1 Definition of end customer

The conditions under item 6 apply to private individuals and companies based in Switzerland or the Principality of Liechtenstein as end users. 

 

6.2 Prices

All prices are per article in Swiss Francs, including VAT. Price changes and time-limited promotions are possible at any time and require no announcement. 

 

6.3 Payments

The payment of the purchase price is optionally made by credit card (VISA, Mastercard), Paypal, or prepayment as provided and available on the website. Data for payment via credit and debit cards are transmitted encrypted. If ArtOnVino accepts the payment of the purchase price on account, the purchase price is due within 30 days after the invoice date. Cash discount deductions are not recognized. For late payments, default interest of 5% is charged. Reminder fees are charged at a flat rate of CHF 20. When purchasing in advance, the desired order is only triggered when the corresponding payment has been received. The items in the order cannot be reserved. If the payment does not arrive at ArtOnVino within 10 days, ArtOnVino can cancel the order. Until the invoice is fully paid, the goods remain the property of ArtOnVino. 

 

6.4 Delivery & Shipping

Costs The delivery is subject to the timely and proper delivery by our supplier or Post AG. In case of force majeure such as strike and other labor disputes, riot, war, natural disasters, and delivery blockades from the manufacturer or supplier, delivery delay does not occur. ArtOnVino is not liable for delivery delays caused by suppliers or by third parties. Should not all ordered goods be in stock, ArtOnVino is entitled to partial deliveries. Should it turn out after the conclusion of the contract that goods cannot be delivered either partially or in total for reasons not to be represented by the seller, the customer is entitled to withdraw from the contract. ArtOnVino also reserves the right to adjust the ordered quantities after the order confirmation, especially for limited available items (see item 6.6). The delivery is made to the invoice recipient or to a delivery address chosen by him in Switzerland or the Principality of Liechtenstein. As a rule, the ordered goods are delivered on our behalf by Post AG, DHL, or DPD following cost regulations:

5 bottles - CHF 18.00 
6 bottles - CHF 21.00

For an order of CHF 500.00 or more, delivery is free. Our service is a debt of delivery and is fulfilled with the handover to the transport person. After shipment, the risk of accidental deterioration and accidental loss of the goods passes to the customer. We are not responsible for any fault of the transport company used. 

 

6.5 General Availability

Our assortment (products, vintages, etc.) consists of limited editions and is subject to constant change. Short-term changes in the range and/or vintage are reserved. Therefore, continuous and constant availability of our offer at http://artonvino.com cannot be guaranteed.

6.6 Warranty

The condition of the received goods must be checked immediately upon receipt; after eight days the delivery is considered approved. Vintages older than 9 years are sold as "buyer's risk". The risk of a possible defect (for example, cork) is borne by the buyer.

7. Privacy

​

The collection and processing of the personal data of customers by ArtOnVino are explained in the privacy policy. This forms an integral part of this T&Cs. The customer hereby agrees to the storage of the personal data entered by him in the course of using the website. This also applies to the storage of the IP addresses that are transmitted each time the website is used. The customer also consents to the use of personal data for the personalization of advertisements and product offers posted on the website. Personal data are not passed on to advertisers. 

 

8. Place of Jurisdiction Swiss law applies exclusively.

The exclusive place of jurisdiction is Basel-City.
